MEETING MINUTES OF THURSDAY, MAY 28, 2009

CALL TO ORDER

Call to order at 5:30 P.M., by Linda Small, Chairman.

MEMBERS PRESENT

Linda Small (LS), Chairman, Ed Vien (EV), Vice-Chairman, Larry Konopka (LK), Denise Morin (DM),), and Paul Skowron (PS), Town Administrator.

(LS) Secretary of State Contact Re: Planning Board, Selectmen Relationship with Staff, Email Re: Secretary of State Contact, Labor Issues; (PS) Non-Public per RSA 91-A:3 II (a) regarding personnel.

ACTION ITEMS

1. Secretary of State Contact Re: Planning Board Composition

(LS) introduced the subject and the Selectmen discussed the opinion received from the Attorney Scanlon from the Secretary of State’s Office. It was concluded that the Town Attorney should be contacted as soon as possible. The discussion ensued and involved a number of questions such as “how would the ballot be set up”? , “how may questions would be on the ballot”?, “how do people get elected or re elected”?, “what is the status of the current cases”?. It was agreed that the Town Administrator would forward all the information concerning the issue of the Planning Board composition to the Town Attorney for an opinion, and request that a response be received prior to the next Planning Board meeting.

2. Selectmen Interaction with Staff

The Selectmen discussed the sequence of events that resulted in the information not being sent to the Secretary of State’s Office concerning the Planning Board composition. (FH) related his recollection of his interaction with staff specifically the Administrative Assistant and the Town Clerk. The Town Administrator had left instructions with the Administrative Assistant to fax the specified information. (LK) said that he and (FH) had discussions about hand delivering the information rather than faxing the information. The result of the events was that the Town Clerk told the Administrative Assistant that (LK) was going to hand deliver the information so that there was no need to fax the same information. (LS) said it was troublesome to her that (FH) and the Town Clerk would get involved with the instructions given by the Board to the Town Administrator to have the information faxed to the State. (PS) did acknowledge that the Town Clerk apologized for getting involved in the matter.

NON-PUBLIC SESSION

(LK) Motion to go into Non-Public Session per RSA 91-A:3 II (a). (DM) Second. Carried 5-0. Individual members of the Board were polled and all agreed.

Board went into Non-Public Session at 5:57 P.M.

Board returned to Public Session at 6:35 P.M.

(EV) Motion to seal Non-Public Session Minutes of May 28, 2009. (DM) Second. Carried 5-0.

(DM) That the Board of Selectmen appoints Diane O’Callaghan to the position as part time Welfare Director, effective as soon as practical, but contingent upon receipt of a satisfactory criminal background check and a satisfactory motor vehicle records check. Compensation for the position shall be in accordance with the union contract based upon the 2009 pay scale step 0 for the respective position. The hours of work are subject to the approval of the Board of Selectmen. There are no contractual benefits associated with this position. (LK) Second. Carried 5-0.
